Terms of Service

1. Agreement

Fregio is a trading name of Graphiq Studio LLC ("Graphiq Studio", "Fregio", "we", "us"), a limited liability company incorporated in the United States. These Terms are a contract between you and Graphiq Studio LLC. By creating an account or using the service you accept them. If you are agreeing on behalf of a company, you confirm you are authorised to bind it. If you do not accept these Terms, do not use Fregio.

2. The service

Fregio provides Muse, an AI agent that designs, generates and edits WordPress sites, together with hosting, preview environments, domain and SSL features, and security tooling according to your plan. Fregio is under active development: features may be added, changed or withdrawn, and we will give reasonable notice before removing something material you rely on.

3. Accounts and eligibility

• You must be at least 16 and provide accurate registration details.
• You are responsible for your credentials and for everything done through your account.
• Tell us promptly at security@fregio.ai if you suspect unauthorised access.
• We may suspend or close an account that breaches these Terms, creates security or legal risk, or is used to abuse the platform. Where practical we will warn you first.

4. Plans, credits and billing

• Paid plans are billed in advance and renew automatically for the same period until cancelled.
• Cancel at any time from your account. Cancellation stops the next renewal; access continues to the end of the paid period.
• Credits meter your use of Muse. They have no cash value, are not currency, are not transferable, and expire at the end of each billing cycle unless stated otherwise on the pricing page. Purchased credit packs carry over per their own terms.
• Prices may change. We will give at least 30 days' notice before a change affects your renewal.
• Consumers in the EEA and UK have a statutory right to withdraw within 14 days. Because the service is delivered digitally and immediately, you agree that performance begins at once and you lose that right once you have used it — outside that, fees are non-refundable except where the law requires otherwise.
• You are responsible for applicable taxes. Failure to pay may lead to suspension.

5. Your content and the output

• You keep ownership of everything you submit — prompts, text, images, video and 3D models — and you are responsible for having the rights to submit it.
• You grant Fregio a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, modify and display that content strictly to operate and support the service.
• As between you and Fregio, you own the site output generated for your account and may use it commercially, subject to these Terms, the terms of the underlying AI providers, and the licence of any third-party font, plugin, theme or stock media involved.
• We cannot and do not warrant that AI output is original, non-infringing or protectable by copyright. Similar prompts can produce similar results for different customers, and in several jurisdictions purely machine-generated material may not attract copyright at all. Review anything you publish, and take your own advice where it matters commercially.
• We may retain and use aggregated, de-identified technical data — such as build durations and error rates — to operate and improve the service. We do not use your prompts, uploads or site content to train our own models.

6. AI output — what we do not promise

Muse is a probabilistic system. It can produce text that is inaccurate or invented, layouts that need correction, and code that behaves unexpectedly. Output is not professional advice of any kind. You are the publisher of your site: you are responsible for checking factual claims, accessibility, regulatory disclosures and anything else the law requires of the site you put in front of the public.

7. Acceptable use

You may not use Fregio to create, host or distribute:

• Malware, phishing pages, scams, or anything designed to deceive people into giving up money or credentials.
• Content that is unlawful, defamatory, or that infringes someone else's intellectual property or privacy.
• Sexual content involving minors, or non-consensual intimate imagery, in any form.
• Synthetic media impersonating a real person or organisation without a clear disclosure and a lawful purpose.
• Content promoting violence, terrorism, or unlawful discrimination.
• Prompts or techniques intended to bypass Muse's safety controls, extract system prompts, attack our infrastructure, mine cryptocurrency, or scrape other customers' sites.

8. WordPress, domains and third parties

Sites run on real WordPress. Plugins, themes and custom code you add are your responsibility, including their security and licensing. Domains you connect stay under your control at your registrar, and correct DNS is your responsibility. We are not liable for outages, changes or losses caused by third-party services, plugins or registrars.

9. Availability and support

We aim for high availability but do not commit to an uptime figure unless a separate written agreement says so. Maintenance, provider incidents and AI provider outages can interrupt builds and hosting. Idle preview environments may be paused; sites on free plans may expire as described on the pricing page.

10. Suspension and termination

You may stop using Fregio and delete your account at any time. We may suspend or terminate access for a material breach of these Terms, non-payment, or where continuing would expose us or other users to legal or security risk. On termination your right to use the service ends; export your sites and content before you close the account, since deletion removes them subject only to our backup cycle.

11. Disclaimers

To the fullest extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. Nothing in these Terms excludes rights that consumer law gives you and that cannot lawfully be excluded.

12. Limitation of liability

To the fullest extent permitted by law, Fregio is not liable for indirect, incidental, special or consequential loss, or for lost profits, revenue, goodwill or data, however caused. Our total aggregate liability arising out of or relating to the service is limited to the greater of the fees you paid in the twelve months before the event giving rise to the claim, or one hundred euros. We do not exclude liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded by law.

13. Indemnity

You agree to indemnify Fregio against claims, damages and reasonable costs arising from content you submit or publish, your use of the service in breach of these Terms, or your infringement of someone else's rights. This does not apply to the extent the claim arises from our own breach or negligence.

14. Changes to these Terms

We may update these Terms. For material changes we will give at least 30 days' notice by email or in the product before they take effect. Continuing to use Fregio after that date means you accept the updated Terms; if you do not, cancel before they apply.

15. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which Fregio is established, and the courts there have jurisdiction. If you are a consumer, this does not deprive you of the protection of mandatory laws in your country of residence, nor of the right to bring proceedings in your local courts.
